(LOS ANGELES) - Kevin Federline's attorney, Mark V. Kaplan, is trying to convince the Court to ban Britney Spears from appealing for enhanced custody of her children, after she missed her court-ordered deposition in her ongoing custody trial a few days ago.

K-Fed's lawyer highlighted that the Toxic singer declared that she was too sick on Wednesday to be present for the deposition, but then she went out partying on Thursday morning.

She was photographed out and about in L.A. by some paparazzi.

Sources say this is the fourth time that the blonde singer has skipped an ordered meeting, and Kaplan obviously has underlined it to the Los Angeles Court, to prevent Britney from asking to restore custody of her kids, Sean Preston and Jayden James.

A new date for Spears' deposition has been chosen, but not made public.
