Southern Oregon Man Arrested After Shooting Involving Police

Josephine County Man Arrested Following Standoff and Shots Fired at OSP SWAT Team‏

(GRANTS PASS, Ore.) - A Josephine County-area man was arrested on multiple charges Friday morning related to an investigation initiated by the Rogue Area Drug Enforcement team.

The arrest followed a brief standoff with the Oregon State Police SWAT team during which the man fired in the direction of SWAT members who responded with chemical munitions and subsequently deployed the use of a taser to arrest the armed man.

A second man was cited and released on several charges. According to OSP Lieutenant Darin Lux, Friday at approximately 5:00 AM, the OSP SWAT team assisted RADE and the Josephine County Sheriff's Office K9 team with execution of an arrest and search warrant at 1800 Lone Mountain Road in the Obrien area.

A wanted felon identified as 39-year old Gerald Bart Batty lived at the residence and was wanted on outstanding felony warrants. The OSP SWAT team was called to execute the search and arrest warrants due to the nature of charges and potential for violence. With the SWAT team in place, BATTY was told to exit the residence. He did so briefly armed with an assault rifle then immediately retreated and secured himself inside.

Batty was ordered to surrender and refused to comply, so SWAT officers delivered chemical munitions into the residence. Batty responded by shooting in the direction of SWAT officers.

SWAT officers say they maintained their positions and continued to attempt to negotiate with BATTY. At approximately 5:30 AM, Batty exited with a firearm visible in his back pants pocket.

SWAT officers deployed a taser and were able to take Batty into custody without injury to anyone. Because Batty reportedly was in possession of firearms and attempted to use a firearm toward OSP SWAT officers, an additional search warrant was obtained. Oregon State Police Crime Lab responded and assisted in processing the crime scene.


The search warrant and crime scene processing yielded a large sum of cash, methamphetamine, marijuana, packaging and distributing materials, and two firearms including an assault rifle.

Batty was lodged in the Josephine County Jail on the following charges:

* Warrant #1 – Unlawful Possession of a Controlled Substance - Methamphetamine, Felon in Possession of a Firearm, Unlawful Possession of a Firearm, and Furnishing False Information to a Police Officer.

* Warrant #2 – Felony Attempt to Elude, Misdemeanor Attempt to Elude, Unauthorized Use of a Motor Vehicle, Interfering with a Police Animal, and Unlawful Possession and Distribution of a Controlled Substance.* Attempted Aggravated Murder

* Unlawful Use of a Firearm* Felon in Possession of a Firearm (two counts)

* Unlawful Possession, Distribution and Manufacturing of a Controlled Substance – Methamphetamine and Marijuana

* Other additional charges will be pending. A second resident, 43-year old David Taylor was cited and released on a warrant charging Fail to Appear – DUII, and local charges of Unlawful Possession of a Short Barrel Shotgun and Possession of less than an Ounce of Marijuana. The investigation is continuing and additional information is expected to be released after the holiday weekend with the approval of the Josephine County District Attorney's Office.
