Measure 37 Claims That Require County/State Action Must be Filed by December 4TH

After December 4th, the state has indicated it will no longer accept the letter as a denial and will instead require that claims filed after that date have a regular land use application denied by the county within the last two years.

(SALEM) - Marion County suggests that those wishing to file Measure 37 claims that require state as well as county action should submit claims to the state no later than December 4th.

Filing by that date will allow use of land use verification letters issued by the county as proof that a proposed use has been denied.

Most Measure 37 claims in Marion County require state, as well as county, waivers of land use regulations. To obtain a waiver, a proposed use must first have been denied under current local land use regulations within the last two years.

Marion County has used simple land use verification letters to deny proposed uses that would violate current regulations and allow claims for compensation or waiver under Measure 37 to go forward.

After December 4th, the state has indicated it will no longer accept the letter as a denial and will instead require that claims filed after that date have a regular land use application denied by the county within the last two years.

This could require fees and an administrative or planning commission process.
