Vaiko's Appeal Letter to Manmohan Singh to save 46 Eelam Tamils Stranded in Australia

"It is a painful tragedy that many of the Eelam Tamils perished in the waves of the ocean when they sailed in boats."

(NEW DELHI) - This is Vaiko's appeal letter to Manmohan Singh to save the 46 stranded Tamils in Australia. Vaiko is a prominent politician in Tamil Nadu, in south India. He is the founder of the Marumalarchi Dravida Munnetra Kazhagam, a political party that espouses the cause of the Tamil people and Tamil nationalism.

Dear Shri Manmohan Singh ji, Vanakkam. With a heavy heart I would draw your immediate kind attention to the following matter of impending danger to the security and lives of 46 Sri Lankan Tamil refugees detained in Australia for the last Five years. These 46 refugees hail from Northern-East of the Island of Sri Lanka who are known as Eelam Tamils. Due to the unimaginable brutal massacre unleashed by the Sri Lankan Armed Forces of the Sinhala Racist Sri Lanka regime, hundreds of thousands of Tamils including children, aged people, mothers including pregnant women were mercilessly killed. Thousands of Tamils were taken by the police, army and thereafter nothing was heard about them. Such disappearances are due to the organized abduction by the Government forces. It is a proven fact that the detained Tamils in prisons have been cruelly tortured. In this background, Eelam Tamils facing mortal danger in the hands of the Sri Lankan armed forces had to flee from their homeland seeking asylum in many countries. It is a painful tragedy that many of the Eelam Tamils perished in the waves of the ocean when they sailed in boats. The above said 46 Eelam Tamils who reached Australia seeking asylum were detained by the Australian Government due to the atrocious security assessment by the Australian Security and Intelligence Organization (ASIO), which has accomplished this without an iota of mercy. Whereas, many European countries have provided succor, solace and asylum to the repatriated Eelam Tamils. I would bring to your kind attention that the historic U.N Human Rights Declaration of 10th December 1948 categorically gives protection to the human beings all over the world. I quote some relevant articles of that Declaration in this regard; “ARTICLE 5 - No One shall be subjected to torture, or to cruel, inhuman or degrading treatment or punishment.” “ARTICLE 14 - Everyone has the right to seek and to enjoy in other countries asylum from persecution.” The above said rights have been acknowledged, accepted and well implemented in almost many democratic countries. In Australia, the ASIO complained that the Tamil refugees have got links with Tamil Independence struggle. There is nothing wrong if the Tamils long for Freedom to liberate their race from clutches of slavery. As per International conventions, the Australian Government is duty bound to protect the Tamil refugees, but on the other hand the refugees were detained, which caused unbearable mental depression and agony. That is why one refugee Two years ago committed suicide. Most of the refugees are detained for more than Four years, some of them with their children and other family members. There is no threat to the Australian community or Government by the refugees. To appease the Sri Lankan Government, the Australian Government has decided to deport these refugees to Sri Lanka. If they are deported there, they will be tortured and eventually may be liquidated. In the recent Commonwealth Heads of Government conference held in Colombo, the Australian Government fully supported the Sri Lankan Government and the Prime Minister of Australia applauded President Rajapaksa and justified the use of torture. The very next day the Australian Government entered into a commercial deal with Sri Lankan Navy. It is most paining that in the last Two years Australia has deported thousands of Tamil asylum seekers to Sri Lanka who faced torture and death there. In this civilized world, the conscience of most of the democracies has awakened and found out that a terrific genocide of Tamils has taken place in the island of Sri Lanka in the hands of the Sri Lankan regime. It is a matter of grave concern that the lives of the 46 Tamil refugees at present detained in Australia may be subjected to mortal danger if they are deported to Sri Lanka. Therefore, I would request you to take immediate appropriate measures through our diplomatic channels taking up the issue with the Australian Government to stop forthwith the move to deport the Tamil refugees to Sri Lanka and allow them to live peacefully releasing them from detention by providing asylum for which I shall be grateful to you.

ஆÞதிரேலியச் சிறையில் வாடும் ஈழத்தமிழர்களைக் காக்க,

பிரதமர் மன்மோகன்சிங்குக்கு, வைகோ அவசரத் தொலைநகல் கடிதம்!

பிரதமர் டாக்டர் மன்மோகன்சிங் அவர்களுக்கு, வைகோ இன்று (18.1.2014) பின் வருமாறு கடிதம் அனுப்பி உள்ளார்.

ஆÞதிரேலியாவில் கடந்த ஐந்து ஆண்டுகளாகச் சிறை வைக்கப்பட்டு உள்ள, 46 ஈழத்தமிழ் அகதிகளின் உயிருக்கு ஆபத்து நேரும் நிலையில், கனத்த இதயத்துடன் இந்தியப் பிரதமருக்கு இந்தக் கடிதத்தை எழுதுகிறேன்.

இலங்கையில் சிங்கள இனவாத ராஜபக்சே அரசு நடத்திய இனப்படுகொலைத் தாக்குதலால், இலட்சக்கணக்கான ஈழத்தமிழர்கள், குழந்தைகள், வயது முதிர்ந்தோர், கர்ப்பிணிப் பெண்கள் உள்ளிட்ட தாய்மார்கள் படுகொலை செய்யப்பட்டனர். பல்லாயிரக்கணக்கான தமிழர்கள் கைது செய்யப்பட்டுக் காணாமல் போயினர். கைதானவர்கள் சித்திரவதைக்கு ஆளாகினர். இந்தச் சூழ்நிலையில் மரணபயத்தால் தங்கள் உயிர்களைப் பாதுகாக்க, ஈழத்தமிழர்கள் உலகின் பல நாடுகளுக்கு அடைக்கலம் தேடிச் சென்றனர். இப்படிப் பயணித்தபோது படகுகள் கவிழ்ந்து பலர் கடலுள் மூழ்கி மடிந்தனர்.

நான் மேலே குறிப்பிட்ட 46 ஈழத்தமிழர்கள், அடைக்கலம் தேடி ஆÞதிரேலியாவுக்குச் சென்றபோது, ஆÞதிரேலிய அரசுப் பாதுகாப்பு உளவு நிறுவனம், (ஹளுஐஊ) துளி அளவும் இரக்கம் இன்றி, அக்கிரமமான ஆலோசனையைக் கூறி, அடைக்கலம் தேடி வந்த ஈழத்தமிழர்களைச் சிறையில் அடைக்கச் செய்தது. ஆனால், உலகின் பல நாடுகள் ஈழத்தமிழர்களுக்குக் கருணையோடு அடைக்கலம் தந்து உள்ளன.

1948 டிசம்பர் 10 ஆம் தேதி அறிவிக்கப்பட்ட ஐ.நா. மனித உரிமைகள் பிரகடனம், உலகில் கோடிக்கணக்கான மக்களுக்குப் பாதுகாப்பு வழங்கியது. அப்பிரகடனத்தின் சில பிரிவுகளைத் தங்கள் கவனத்திற்குக் கொண்டு வருகிறேன்.

பிரிவு 5: எந்த ஒரு மனிதனும், கண்ணியத்திற்கு மாறாக நடத்தப்படுவதோ, கொடுமையான சித்திரவதைகளுக்கு உட்படுத்தப்படவோ கூடாது.

பிரிவு 14: எந்த ஒரு மனிதனுக்கும், கொடிய அடக்குமுறையில் இருந்து தப்பிப்பதற்காக, எந்த ஒரு நாட்டிலும் அடைக்கலம் கேட்கவும், பெறவும் உரிமை உண்டு.

உலகின் பெரும்பாலான நாடுகள், இந்த உரிமைகளை ஏற்றுக் கொண்டு செயல்படுத்தி வருகின்றன. ஆனால், ஆÞதிரேலியாவில் அந்நாட்டின் பாதுகாப்பு உளவு அமைப்பு, அங்கு வந்த ஈழத்தமிழ் அகதிகள், இலங்கையில் நடைபெற்று வருகின்ற தமிழ் ஈழ விடுதலைப் போராட்டத்தோடு தொடர்பு உடையவர்கள் என்று குற்றம் சாட்டி உள்ளது.

அடிமை விலங்குகளில் இருந்து தங்கள் தாயகம் விடுபட, சுதந்திரம் பெறத் தமிழர்கள் ஏங்குவதும், அதற்காக அக்கறை காட்டுவதும், எந்தவிதத்திலும் தவறு அல்ல. இந்த அகதிகளால் ஆÞதிரேலிய மக்களுக்கோ, அரசுக்கோ எந்த இடையூறும் கிடையாது.

அனைத்து உலக ஒப்பந்தங்களின்படி, தமிழ் அகதிகளைப் பாதுகாக்க வேண்டிய கடமை ஆÞதிரேலிய அரசுக்கு உண்டு. அதற்கு மாறாக, கடந்த நான்கு ஆண்டுகளாகச் சிறையில் அடைத்து வைத்து இருப்பதால், அவர்கள் தாங்க முடியாத மனத்துன்பத்திற்கும், அழுத்தத்திற்கும் ஆளாகி உள்ளனர். அதனால், இரண்டு ஆண்டுகளுக்கு முன்பு ஒரு ஈழத்தமிழ் அகதி தற்கொலை செய்து கொண்டார்.

இலங்கை அரசாங்கத்தைத் திருப்திப்படுத்துவதற்காக, ஆÞதிரேலிய அரசு, தமிழ் அகதிகளை இலங்கைக்கு அனுப்ப முடிவு செய்து உள்ளது. அப்படி அவர்கள் அனுப்பப்பட்டால், அங்கு சித்திரவதைக்கு உள்ளாகிக் கொல்லப்படுவார்கள்.

அண்மையில் கொழும்பில் நடைபெற்ற காமன்வெல்த் மாநாட்டில், உரை ஆற்றிய ஆÞதிரேலியப் பிரதமர், இலங்கை அரசுக்குச் சாதகமாக, அதிபர் ராஜபக்சேவுக்கு ஆதரவாக, அரசு நடத்தும் தாக்குதலையும், சித்திரவதையையும் நியாயப்படுத்திப் பேசினார். மறுநாளே, இலங்கை அரசோடு ஆÞதிரேலிய அரசு வணிக ஒப்பந்தம் போட்டு, இலங்கைக் கடற்படைக்கு இரண்டு கப்பல்களையும் வழங்கி இருக்கிறது.

இன்றைய நாகரீக உலகில், பல ஜனநாயக நாடுகளின் மனசாட்சி விழித்துக் கொண்டது. இலங்கைத் தீவில், சிங்கள அரசு நடத்திய தமிழ் இனப்படுகொலையை உணர்ந்து கொண்டன.

கடந்த இரண்டு ஆண்டுகளில், ஏராளமான தமிழ் அகதிகளை ஆÞதிரேலிய அரசு இலங்கைக்கு அனுப்பியதால், அவர்களுள் பலர் துன்பத்திற்கு ஆளாகி மடிந்தனர். எனவே, தற்போது ஆÞதிரேலியாவில் உள்ள 46 தமிழ் அகதிகளையும் அங்கிருந்து இலங்கைக்குத் திருப்பி அனுப்ப விடாமல் தடுத்து, அவர்கள் உயிர்களைப் பாதுகாக்க உரிய தேவையான நடவடிக்கைகளை, இந்தியப் பிரதமர் அவர்கள் தூதரக உறவுகள் மூலமாக உடனடியாக மேற்கொள்ள வேண்டுகிறேன்.

சிறையில் அடைக்கப்பட்டு உள்ள தமிழ் அகதிகளை விடுதலை செய்து, அவர்களுக்கு அடைக்கலம் தந்து, ஆÞதிரேலிய அரசு மனிதாபிமானத்தைக் கடைப்பிடிக்கவும் தேவையான நடவடிக்கைகளை மேற்கொள்ள வேண்டுகிறேன்.
