Elderly Oregon Woman In Financial Ruins; via America's Worst Son?Bonnie King Salem-News.comFinancial elder abuse is a bigger problem than the authorities can manage. BUT~ isn't that their job?
(SANDY, Ore.) - Erna Boldt came to the U.S. in the 1950's as a war bride. She worked all her life, creating a stable home and a financially secure future. In 1998 she created an Estate Plan, in which she gave half of everything she owned to her son, upon her death. "He knew all along that whatever I put in my estate plan, was for after my death," Erna Boldt said. "In fact I gave him half of it so he would have access to everything. But the way it turned out, the courts gave him all of it. It just doesn't stand to reason. Why? Because he had a smart attorney. But I feel he didn't outsmart me because I caught on." Leroy Newton, Erna's only child, is an investment banker in California. Erna trusted his knowledge and advice. The next thing she knew, her house, her stocks and all her worldly goods were the property of her son. Far before her death. She appealed his creation of a trust that kept her from accessing her own money, and she won. She changed her house back into her name, and waited for her other assets to be returned.
Sadly, there was a lack of follow through by the Clackamas County Oregon lower court, "administrative neglect" it's called. The court documents from Erna's "win" were never filed, and therefore left her son a window to finalize his takeover. When Erna learned of this mishap, she appealed to the court to uphold the decision in her favor, and she was denied. Next, a trustee was assigned to Erna's inheritance without her ever being declared "Incompetent". Eight years later, now recovering from a stroke, Erna has spent herself into debt defending her right to her own property. Her son has fought her all the way. Finally, in November of 2007, the Oregon State of Appeals court agreed to allow the documents to be submitted, and the case revisited. Erna filed the paperwork in January 2008 and her son's attorney drug his feet in responding, receiving two extensions after defaulting, and even missing the extension deadline by three days. His paperwork was accepted, nonetheless. Erna's a survivor, and she's vowed not to let her son get the best of her. She intends to see justice served. Salem-News.com will be watching to see if Oregon's judicial system will rise to the occasion, and take a stand for our aging citizens, or add to the pain and suffering of the elderly. Both the Supreme Court, and common sense, tell us that "justice must satisfy the appearance of justice". That remains to be seen. WATCH THE VIDEO REPORT BELOW:

Our legal system has let us down. Crooks like the one sitting in the Ferarri have lost sight of what's right in the world- along with our justice system. I have to widen my forum, because Oregon seems to ignore an elders rights to her own property. The guy need to be reported along with his sleazy attorney. If I were the mother of this Newton guy, I would "break" them both, but usually, the attorney is making all the money. He lied and had hoped to get away with hiding the truth from the courts. No body has rights to an inheritance but what is freely given. I hope he is aware, what they will do to him, once the truth is out. No one has a legal interest in his mothers property, but what has been dedicated in a Testament unpon her death. The Clackamas County District Attorney is well aware of his deeds, for instance,that he violated the Power of Attorney, when he stole her documents( confirmed by the Bank)and used those documents to gain access to his inheritance by fraud. His attorney is, what is generally known, as an unscupulous member of the Oregon Bar Association, Who encouraged his client to pursue a "legally questionable) course of action. Newton may not only be the worst son, he turned out to be the greediest son in America. I wonder, what his clients think of such a questionable character? ? And the "Worlds Worst Son" is totally crazy, how about "Worlds Best Son But His Mom Doesn't Believe That". There is no justice needed. None of this is true? Oh come on, you know it is and so does God and everybody else. Just because a lawyer was able to get this through a questionable court doesn't mean the son is off the hook. He has to live with himself every day and that is probably pretty hard, but only if he has remorse. Most people who have what it takes to drain their elderly mother's savings don't have remorse. Editor: Well that's really nice that you are fond of your uncle. I'll bet he's super nice to little relatives like yourself and he probably loves you a great deal. I'll bet he likes to spoil you too, yes? Nothing beats a rich uncle. Be sure to always advocate for him and keep your stake in things, they way you're doing here. My understanding per his mother, is that he came up from Calif. to visit her and he brought a friend. Your nice uncle then reportedly took her out to lunch and the friend who supposedly "wasn't hungry and was just going to watch TV" rifled through all of her financial records and that is how this nice uncle of yours ended up with his mother's money. It was wrong, Erna Boldt is a wonderful woman who worked hard for what she had. She put her son through college only to have this be the reward? So the Ferrari was a rental, eh? Maybe so, but that wasn't the way we understood it and it sure doesn't mean much to Erna either way. It is interesting that we caught up with this story, and we have a whole bunch of data that we haven't even brought forward yet. I think your uncle has very good qualities and that is why his mom who he threw under the train so to speak, still gets teary eyed when she talks about him. I have covered cases where children killed their parents, vice verse, and all kinds of horrible things. There is a bond in family that is supposed to keep things like this from ever happening.
