Mistaken Pipe Bombs in Keizer Were Marijuana Containers

What a woman believed were bombs, were plastic PVC tubes which may have been used to extract THC from the marijuana.

(KEIZER, Ore.) - A house on Newberg Drive North that has been raising a lot of attention in Keizer over a legal medical marijuana grow located close to a high school, is back in the news again. Keizer Police say it stems from a former resident's 911 call on Wednesday afternoon.

Megan Lauch told police she spotted PVC tubes in the residence, and thought they were pipe bombs. The resident, Anthony Beasley, was not home at the time police were called, according to Captain Jeff Kuhns of Keizer Police.

"Officers from the Keizer Police Department responded and made contact with Ms. Lauch within 5-minutes of receiving this information. Responding officers confirmed the information Ms. Lauch had reported and then requested the Salem Police Department Bomb Squad respond to further examine the suspected explosive devices."

But further examination of the devices with the assistance of a robot allowed bomb technicians to learn that they were not explosive devices, Kuhns said.

"After one of the devices was disrupted officers discovered the PVC pipe was not an explosive device. They discovered the inside of the PVC pipe was filled with Marijuana. Further examination of the second device revealed the same; it too was filled with Marijuana."

Kuhns says the pipes had been taken outside by officers where they could be disrupted through a controlled detonation. Beasley's residence has been a hotly contested notion in Keizer, city officials were very uncomfortable with the outdoor grow site's proximity to the high school.

"This is the same residence that has been the subject of recent media reports discussing a medical Marijuana growing operation near McNary High School, and that nine Marijuana plants were reported as stolen by Anthony Beasley on October 10th," Kuhns said.

In explaining how she ended up inside the house to start with, Lauch told officers she previously resided at this residence and returned on October 17th to collect some of her personal property. After entering the residence she told officers she observed what she thought were two pipe bombs sitting on a coffee table in the living room.

Kuhns says that although the resident Anthony Wyatt Beasley, was not at the residence when officers made contact with Ms. Lauch, he heard about the police and bomb squad presence at his residence and contacted 911.

"Mr. Beasley reported the PVC pipes were not pipe bombs or explosive devices. He said the tubes were being used to extract THC (Tetrahydrocannabinol) from the medicinal Marijuana." Kuhns says officers did not contact Beasley in person at that time and the investigating officers left the residence a short time after the devices were found not to be explosives.

Kuhns says the investigation of this incident continued on Thursday, October 18th and Friday, October 19th.

"Investigators obtained a search warrant earlier today for the residence at 5152 Newberg Drive North that authorized them to search for items associated with the unlawful manufacturing of a controlled substance. A search warrant was requested because investigators believe Mr. Beasley was unlawfully manufacturing a Schedule I controlled substance within 1000 feet of a school."

Specifically, Kuhns says investigators had probable cause to believe Mr. Beasley was using medicinal Marijuana to manufacture hashish or hash oil using an extraction method that utilized the PVC pipes and other materials. Hashish or hash oil is a Schedule I controlled substance. Unlawfully manufacturing or delivery of a controlled substance within 1000 feet of a school is a Class A felony.

Members of the Keizer Police Department executed the search warrant at about 1:30 PM friday afternoon. Nobody was home when officers arrived.

Members of the Keizer Police Department located Anthony Beasley in Keizer later in the afternoon and interviewed him. At the conclusion of the interview he was placed under arrest for one count of Unlawful Manufacture of a Controlled Substance within 1000 feet of a school.

Oh and hopefully my first post makes it through admin. approval. If you think he is wrong for growing this medicine then you think Oregon is wrong (that means everything), and if Oregon is wrong then that means the federal government is wrong for allowing states to make their own laws...cause that would be crazy...I though we were still in the 1400's, and back in the UK. Also it has become DEA policy to no longer raid MMJ patients, clinic's, clubs, or dispensaries deemed legal by the states in question.

Wow Fetus Albert Einstien said something that applies directly towards you; "Two things are infinite: the universe and human stupidity; and I'm not sure about the universe." You honestly have no idea what its like to go through pain every single day. I suffer from severe back pain every single day, some days its so bad that I can't get out of bed to work my 9 hour shift. I am 20 years old, and MMJ (Medical Marijuana) is the only medicine that is strong enough to dull the pain, and make it bearable to make it through a normal day, and not be made a vegatable from "legal" drugs that are MUCH stronger...and man made instead of occuring naturally in nature. Sure I have the ability to get back surgery, have rods, and screws placed in my back, have very painful bone grafts from my hips taken...oh yes and due to that I wouldn't be able to play sports that I love, any would have to schedule my day around having these rods in my back as well as months of rehab. So yeah we are doing "illegal" activities to keep a normal life that everyone else is allowed. Lets see certain states have made it legal for doctors to perscribe MMJ to patients that ACTUALLY require it...funny thing is that those doctors have medical degrees that allow them to make an educated decission that you obviously aren't smart enough to make, because the only place you can make your ignorant statement is on the web where everyone can say what they want. I am friends with many police officers, and I know the Police Cheif in my city on a first name basis (not from being arrested :D) and they are great people, the KPD went around this entirely WRONG, and for that they should take 100% of the blame, and fall on the proverbial sword. Should Mr. Beasely have an outdoor crop that plants are able to be stolen by kids? No, he should have an indoor crop and take security precautions so that breakings are less likely, and plants won't be stolen. I like how his nosey neighbor was spying through his windows. She should have her neck chopped down a bit so she can't peak into someones home which is their personal space. Ummm...yeah think I covered everything that bothered me with this story.

Well, this case has been dropped. The Grand Jury saw through the false and misleading process that the police followed once they realized that their search warrant (for bomb-making?) was erroneous. They looked around until they could trump up other charges. Bad Cops!

Festus - can you prove he was not growing medicine? Do you or Keizer PD have any evidence of him SELLING the product? You ARE aware the OMMA allows any use of the plant which includes medicinal use of hash (which is just concentrated THC). Just because it has a different name doesn't make it a different thing. For example vicodin, lortab and lorcet are all hydrocodone. Should they legalize vicodin but criminalize medicinal use of lorcet? Really? Ah well...

Funny how the Keizer Police are the ones taking the fall on this! Sounds like the Keizer Police are the only ones with the nuts to deal with these dirt bags who try to hide under the OMMA. Keep rockin Keizer PD. I am glad you are taking action against these morons that claim they are growing medicine.

I swear there is something in the water out there! I know I feel a lot smarter since I moved away from Keizer! I agree with Neal that they should look into suing the city but doing that will bring the feds into it, and I'm not sure that's best what with a Supreme Court on a mission from George and a a George on a mission from God! I think it seriously falls onto the shoulders of those in the program to present as good a face as possible to the public. Every time something like this happens it's an opportunity for both sides to play the fool. All the old school folks are goin' "See I told you so!" The Keizer police need no help looking foolish, so my advice to anyone else in Oregon growing their own medicine is to remember this: It's still against the Law!!! dp

Exactly. They arrested him on bogus charges for doing something he is legally entitled to do. It is like trying to arrest parents for assault and battery for spanking their kids when the law specifically allows them to do so. Like I said I hope he sues the whole place from top to bottom into bankruptcy and oblivion. Ah well...

This is how the Oregon Statute regulating medicinal marijuana defines usable marijuana: "(11) “Usable marijuana” means the dried leaves and flowers of the plant Cannabis family Moraceae, and any mixture or preparation thereof, that are appropriate for medical use as allowed in ORS 475.300 to 475.346. “Usable marijuana” does not include the seeds, stalks and roots of the plant." Why did they take his ground up marijuana since it's considered useable? And hash is only an extract of the marijuana, no foreign chemicals, no plant material that can be carcinogenic. Let's grow up and focus on something a little more serious than a medical user following the guidelines set forth by the very state that has incarcerated him.

Yet another example of how Keizer will violate the rights of those under the OMMA. Last I checked it allowed for any use of the plant product which would include hashish or hash oil. This is just further harassment and I hope Mr Beasley sues the city of Keizer, its police dept and any and all officers involved personally into perpetual bankruptcy. Apparently when they cannot legally stop something they disagree with they illegally fabricate notions or just simply engage in harassment programs. Ah well...
